This summary is here to help. The full text below is what applies.
1. Who we are and agreeing to these Terms
MyFinancialOrbit (the "Service"), available at https://myfinancialorbit.ca, is operated by Noah Dewaal ("we", "us"). These Terms of Service ("Terms") are an agreement between you and us about your use of the Service.
By ticking the agreement box, creating a workspace or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Disclaimer, which form part of them. If you don't agree, please don't use the Service.
You must have reached the age of majority in the province, territory or country where you live (18 or 19 in Canada, depending on the province) to create your own workspace. You may explore the fictional demo without an account.
2. What the Service is
MyFinancialOrbit is a personal finance organizer and learning tool. It helps you record and categorize your income and spending, set budgets and goals, track what you own and owe, explore "what if" scenarios and calculators, keep a private journal, and ask questions of Orbit, a built-in assistant.
- It doesn't connect to your bank or move money. Everything is entered or imported by you.
- It doesn't provide live market prices, trading, lending, insurance or payments between people.
- It is still being developed. Features may be added, changed or removed, and parts may be labelled as previews.
3. Not financial advice
The Service, including Orbit's answers, forecasts, calculators, budgets, tax estimates, scenarios, goal plans, growth pathways and earning ideas, is for general information, organization and education only. It is not financial, investment, tax, accounting, legal, insurance or other professional advice, and it is not a recommendation to buy, sell or hold any security or financial product.
We are not a registered investment dealer, adviser, portfolio manager or financial planner, and we are not accountants or lawyers. Nothing in the Service takes into account your full personal situation. You are responsible for your own decisions. Before making an important financial decision, talk to a qualified professional such as a licensed financial planner, accountant or lawyer. Read the full Disclaimer.
4. Orbit and AI features
Orbit can work in two ways. By default, it answers using set rules that run in your browser. If live AI is available and you turn it on in Settings, a summary of the areas of your data you allow, your question and recent messages are sent to a third-party AI provider to generate an answer (see the Privacy Policy).
- AI answers can be wrong, incomplete, out of date or inconsistent, even when they sound confident. Check anything important yourself.
- AI answers are generated automatically and are not reviewed by a person before you see them.
- Don't share passwords, full account or card numbers, government ID numbers (such as your SIN) or other sensitive identifiers with Orbit.
- Orbit can't move money or change your records. You decide whether to act on, save or insert anything it suggests.
5. Your account
Accounts are currently by invitation. You agree to give accurate sign-in details, keep your password private, and tell us promptly through our contact form if you think someone else has accessed your account. You are responsible for activity in your account that you could reasonably have prevented.
Without an account, a workspace is stored only in your browser. Clearing your browser data or changing devices can remove it, so export a copy regularly from Settings.
6. Your information and content
You own the information you put into the Service, such as transactions, budgets, goals, journal entries and files you import ("Your Content"). You give us a limited permission to store, process, back up and display Your Content only as needed to run the Service for you, as described in the Privacy Policy. We don't sell Your Content.
You confirm you have the right to use what you upload. Please only import statements and screenshots for your own accounts, or accounts you're allowed to manage.
If you send us feedback or an Update Request, you allow us to use the idea to improve the Service without owing you anything. We won't publish your name or personal details with it without your permission.
7. Acceptable use
You agree not to:
- break the law or anyone else's rights while using the Service;
- try to access another person's account or data, or test, probe or get around our security, usage limits or access controls;
- use automated tools to scrape, overload or disrupt the Service, or use Orbit as a general-purpose AI service for unrelated purposes;
- upload malware or content you don't have the right to share;
- copy, resell or reverse-engineer the Service except where the law allows it.
8. Plans, trials and payments
Standard is free. Premium adds extra features listed on the Pricing page. New accounts receive a free Premium trial (currently 3 months). When a trial ends without a paid plan, your account moves to Standard and keeps all of your data.
Payments are not turned on yet. Any checkout shown in the Service today is a preview: no card details are collected and you won't be charged. Prices shown (currently $7.99 per month or $79.00 per year, in Canadian dollars) may change before payments start.
When paid plans start, we will update these Terms first and, before you pay, clearly show:
- the price, applicable taxes and how often you'll be billed;
- that the subscription renews automatically until you cancel, and how to cancel (you'll be able to cancel at any time from the Plans page);
- what happens when you cancel (Premium continues until the end of the period you've paid for), and our refund policy.
Card payments will be handled by a third-party payment processor. We will never see or store your full card number. We will give you notice before any price change applies to an existing subscription.
9. Third-party services
The Service relies on other companies, such as our hosting, database and AI providers, listed in the Privacy Policy. Links to other websites, and any third-party products mentioned in the Service, are for convenience. We don't control them and aren't responsible for them. We don't receive payment for mentioning any financial product.
10. Our content
The Service's software, design, text, logos and the fictional demo data belong to us or our licensors. You may use them only to use the Service as intended. The name MyFinancialOrbit and its logo may not be used in a way that suggests we endorse you or your product.
11. No guarantees
We work hard to make the Service accurate, secure and available, but to the fullest extent permitted by law the Service is provided "as is" and "as available". We don't promise that it will be uninterrupted, error-free or secure at all times, that calculations, estimates, categorizations, imports or AI answers will be correct or complete, or that your data will never be lost. Keep your own records of anything important and export your data regularly.
Some laws, including consumer protection laws in Quebec and other provinces, give you warranties or rights that can't be excluded. Nothing in these Terms limits those rights.
12. Limits on our responsibility
To the fullest extent permitted by law:
- we are not responsible for financial decisions you make or losses you suffer because you relied on the Service, including its forecasts, estimates, calculators, budgets or AI answers;
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, savings, opportunities, data or goodwill;
- our total liability to you for all claims about the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, and CAD $50.
These limits don't apply where the law doesn't allow them, for example to liability for our gross negligence or intentional misconduct, or to rights you have as a consumer that can't be waived (including under Quebec's Consumer Protection Act and Civil Code).
13. If you misuse the Service
To the extent permitted by law, you agree to cover reasonable losses and costs we incur because you broke these Terms or the law, or infringed someone else's rights while using the Service. This doesn't apply to losses we caused.
14. Ending your use
You can stop using the Service at any time. You can export your data and delete your workspace or your whole account from Settings → Your data, or ask us to do it through our contact form.
We may suspend or close an account that breaks these Terms, puts the Service or other people at risk, or where the law requires it. Unless it's urgent or we're not allowed to, we'll tell you first and give you a reasonable chance to export your data. If we decide to shut down the Service, we'll give at least 30 days' notice where we reasonably can.
15. Changes to these Terms
We may update these Terms as the Service changes or the law requires. We'll post the new version here with a new effective date. If a change is important, we'll tell you in the app (and by email if you have an account) before it takes effect, and ask you to agree again. If you don't agree, you can stop using the Service and delete your data.
16. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live in another province or country, you also keep any protections the laws where you live give you that can't be changed by agreement, including the right to bring a claim in your local courts where that law provides it.
If you have a concern, please contact us first through our contact form. We'll try to resolve it informally within 30 days.
17. General
- These Terms, the Privacy Policy and the Disclaimer are the whole agreement between you and us about the Service.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part of these Terms right away, we can still enforce it later.
- You may not transfer your rights under these Terms. We may transfer them to someone who takes over the Service, as long as your rights aren't reduced, and we'll tell you if that happens.
